Welcome to iPlayer. These Terms of Service (“Terms”) are a legal agreement between you and the iPlayer team. By using or continuing to use the app, you agree to be bound by these Terms.
Scope
These Terms apply to the iPlayer app and its website pages (e.g., download and help). Third-party services (e.g., cloud storage) are governed by their own terms and privacy policies.
Eligibility and Accounts
- You represent that you have the legal capacity to enter into this agreement in your jurisdiction.
- iPlayer does not require an account to use core features (local playback and management). If account features are introduced in the future, we will provide separate terms.
Rights and License
- License: subject to these Terms and applicable laws, you are granted a non-exclusive, non-transferable, non-sublicensable, limited license to install and use iPlayer on your device.
- Content ownership: you are responsible for and retain rights to your audio files. Ensure you have lawful sources and permissions.
- Updates: we may release updates to fix issues or add features; you consent to receiving such updates.
User Conduct and Prohibited Uses
You agree not to:
- Use the app for unlawful or infringing purposes, including distributing illegal content, bypassing DRM, or violating copyright laws.
- Scrape, reverse engineer, attempt to access source code, or circumvent security measures without authorization.
- Commercialize without permission (e.g., resell, mass distribute).
- Interfere with or disrupt normal operation, including injecting malicious code or excessively consuming resources.
Third-Party Services
If you choose to use cloud or external storage services (e.g., iCloud Drive, Dropbox, Google Drive) to import files, those services are governed by their own terms and privacy policies. You should review and comply with them.
Fees and Refunds
iPlayer core features are currently free. If paid features or subscriptions are introduced, we will clearly state pricing, billing cycles, and refund policies on the purchase pages and in updated terms.
Disclaimers
- As-is: iPlayer and related services are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Content sources: we are not responsible for the legality, integrity, or security of audio files you import.
- Third-party services: we do not guarantee the availability or security of third-party cloud or storage services.
Limitation of Liability
To the maximum extent permitted by law, the iPlayer team shall not be liable for any indirect, incidental, special, or punitive damages arising from the use or inability to use the app, including data loss, lost profits, or business interruption.
Termination
If you violate these Terms or applicable laws, we may suspend or terminate your use of the app, in whole or in part, without notice. You may discontinue use at any time by uninstalling the app.
Governing Law and Dispute Resolution
These Terms are subject to mandatory consumer protection laws and general contract principles in your region. Disputes should first be resolved amicably; failing that, you agree to submit to a court of competent jurisdiction.
Changes to the Terms
We may update these Terms from time to time to reflect feature changes or legal requirements. For material changes, we will notify you in-app or on our website and update the “Last updated” date. Continued use constitutes acceptance.
